Krishna district ,Pamarru MLA T.Y Das has filed a petition in the High Court calling the AP Assembly election as unconstitutional and to be postponed. The petition was admitted by the main bench consisting of Chief Justice Kalyanjyothi Sen Gupta and Justice Sanjay Kumar who have asked for the State Election Commissioner Mr Bhanwar Lal to appear before the court.
The petitioner had questioned as to how the elections could be conducted even before the tenure of the assembly was over and as a unified state. Then to elect representatives and then divide them between the states was against the constitutional tenets and that the election conducted in such a fashion was unconstitutional. The High Court admitted the plea with an explanation from the State Election Commission as to whether the bifurcation of the state and the elections can happen simultaneously.
