Two accused in gang rape pleads for legal aid
Out of the six accused arrested in the brutal gang rape case in Delhi, two pleads for legal aid and two others appeals the court to allow them to become witnesses in the case. Four accused were produced before the Metropolitan Magistrate Jyoti Kler whose 14day remand expires on Sunday.
The 5th accused in this case Akshay Thakur was not produced before the court today. Since, his judicial custody ends on January 9th, the police have decides to produce him before court on Monday.
The 6th accused has the privilege of being minor will be tried in Juvenile Justice Board soon. Although, he is just five months short to be a major, he is the one who played the key role in this brutal rape and murder case. Unless, the government amends the present laws immediately he has all the privilege of being a juvenile to escape the severe punishment.
Pawan Gupta and Vinay Sharma who refused to have the legal aid have pleaded the court to allow them to become witnesses in the case, in a desperate bid to escape the severe punishment. But, the main accused in this case Ram Singh and his brother Mukesh have sought for legal aid to defend themselves in the case. Hence, Magistrate Jyothi has ordered Ram Singh and Mukesh to move the court with an appropriate application seeking permission to become witnesses in the case. She ordered the government to provide legal aid to the other two. She extends their remand till January 19thand asked the police to produce the four in the court on January 7th for the trail.
The five of the six accused have been charge sheeted under sections 302 (murder), 307 (attempt to murder), 376 (2) (g) (gang rape), 377 (unnatural offences), 395 (dacoity), 396 (murder in dacoity), 394 (hurting in dacoity), 201 (destruction of evidence), 120-B (conspiracy), 34 (common intention) and 412 (dishonestly receiving stolen property) of the IPC.
