The combined High Court of Andhra Pradesh and Telangana states can’t be divided in the present circumstances said the High Court bench led by Chief justice Kalyan Jyothy Sen Gupta. He made it clear that a separate High Court can’t be formed for the Telangana state until the AP government constructs buildings for the High Court within the state. Telangana government also can’t shift its High Court to any complex in the city as it would be violating the AP Reorganization Bill. However, Telangana government can set-up High Court bench if the Supreme Court allows for it says the High Court bench.
The High Court’s verdict may be very much disappointing to the Telangana lawyers, who are anxious to have a separate High Court for the state. But, it would be interesting to know that earlier in the last month Chief Justice of India HL Dattu has assured the Telangana Lawyers JAC, who came to meet him that he will ask the Chief Justice of the High Court Kalyan Jyothy Sen Gupta to speed-up the bifurcation process of the combined High Court.
But, Mr. Sen now made it clear that the High Court can’t be divided until the AP government readies the buildings for its High Court within the AP state. So, it is understood that the ball is thrown back into the Supreme Court.
