SC refuses stay against State bifurcation

 

 

 

The Supreme Court today refused to impose a stay based on the 12 petitions which were already filed by SRCP MP Mekapati and few lawyers along with Andhra Pradesh Ex-chief minister Kiran Kumar Reddy against the State of AP’s bifurcation.


The petitions filed was about how the Indian Government  failed to follow the proceedings in the Constitution and bypassed all rules and regulations .It was termed as unconstitutional hence the decision should be stayed was the min contention of the petition. The petition filed by Mr Kiran Kumar Reddy was a last a last minute effort for the preserving the state unity. The three-member Supreme Court bench headed by Justice H.L Duttu reviewed the petition and refused to give stay orders The bench has  referred to its earlier order of November 18,2013, when it had said that it was premature at that time to hear any petition relating to the against to the bifurcation of Andhra Pradesh. “We do not see any change in the stage between November 18, 2013 and today (February 7). So we decline to interfere at this stage,” the bench had said. However the Court has issued notices to the Center and has asked for written statements to be files by the Central Government. Based on these findings the Supreme Court will decide whether it should be passed on to the Constitutional bench and decide the further course of action as appropriate.
