Marital Rape is something that Indian society has been discussing for a long time... though in whispers. But times have changed and Indian women were started raising their discontent against the issue. Feminists have been arguing that having sex with wife without her consent should be treated as Rape and should be punishable. Many countries in the world have declared marital rape as an offence. Indian judiciary has been avoiding such laws and marital rape is considered to be legal and natural in India. But the scenario might be changing soon. The High Court of Gujarat while hearing a case has observed that `marital rape should be made illegal’. This is probably the first such remark from judiciary and activists hope that such an initiative would soon prompt the government to pass an act against the marital rape.
