Summons Issued to TN Governor K Rosaiah in Land Scam

The ACB (Ant--corruption Bureau) court at Hyderabad issued summons to the Tamil Nadu Governor Sri K Rosaiah to appear before it in connection with an alleged land scam when he was chief minister of Andhra Pradesh.
The court asked Mr. Rosaiah to appear on August 2 in connection with a land grant made during his brief tenure as chief minister from September 2009 to November 2010. The ACB had probed Rosaiah’s alleged role in denotifying over nine acres of prime land at Ameerpet in Hyderabad, valued at around Rs 300 crore at current rates, for sale to a private individual.
The court has registered a case against Rosaiah under Section 409 (criminal breach of trust by a public servant) of the Indian Penal Code and under Sections 13 (2) and 13 (1) (d) of the Prevention of Corruption Act. However, it has to be seen whether the court has jurisdiction over a constitutional head of a state. Article 361 (2) of the Constitution states that "no criminal proceedings shall be instituted or continued against the President or the governor of a state in any court during his term of office". Some lawyers, however, claimed that the case had been filed against Rosaiah even before he became governor and hence he can be tried in the case.
Interestingly, before his elevation as governor, the ACB had absolved Rosaiah of all charges and filed a report before the same court. But the court has now directed the investigating agency to probe the allegations further. The directive came in the wake of recent statements of some senior bureaucrats in the chief minister’s office and officials in the municipal administration ministry when Rosaiah was chief minister.
