NAC's draft Communal Violence Bill protects migrant workers

The Sonia Gandhi-led National Advisory Council (NAC) Thursday decided to put its long-awaited draft Communal Violence Bill, With a wider ambit of vulnerable sections of the society,In the public domain and discuss it again after assessing the people's views, a statement said Thursday. Based on the feedback received, the working group of NAC shall review the draft Bill and place the final version for consideration before the NAC at its next meeting," the release said after a NAC meeting, which was presided over by Gandhi.The draft has been titled Draft 'Prevention of Communal and Targetted Violence (Access to Justice and Reparations) Bill, 2011.     The Bill has taken into account the recent pattern of attacks in Maharashtra and some other regions on migrant workers from outside the states, a legal analyst told IANS. "Failure of command responsibility has been made an offence to ensure accountability at the highest level," the release said. "The offence of breach of command responsibility is extended to non-state actors also," it added. "A major stumbling block in prosecuting public servants is the provision for getting sanction under S.196 and 197 of the Code of Criminal Procedure," the NAC said. The Bill provides that if such sanction is not granted 30 days from the date of application to the state government, sanction to prosecute will be deemed to be granted. The draft Bill also provides for constitution of a national authority and state authorities as the primary monitoring and grievance redressal mechanisms. "The principle behind this is not to supersede the existing law enforcement machinery, nor to disempower or paralyze the existing administrative and justice mechanisms, but rather to strengthen them and make them more accountable," the draft Bill says. Certain new offences - sexual assault, enforced disappearances, torture, persecution, and enforced migration  have been defined as offences under the Draft Bill. "Additionally, mass violence that is widespread or systematic in nature is also defined specifically as organized' communal and targeted violence," the release said. The NAC draft Bill also seeks to "strengthen the rights of the victim, through a series of new provisions - from the simple right to information at all stages, the right to get copies of all their statements, to the right to be heard in a court," the release said.

AI Operating Only 50 Out Of 320 Flights Today

As the strike by Air India pilots entered the third day on Friday, The national carrier drastically reduced its operation to 50 flights across its network against the regular 320 as all executive pilots joined the stir. "Under the contingency plan, we are operating 50 flights across the network today," an Air India official said. According to Air India spokesperson, the cash strapped national carrier is losing Rs 4 crore per day due to the strike.     However, sources said, this figure might be more as the airline has liabilities towards payment of installments of new and leased aircraft and the salary of its employees. Eecutive pilots also joined the agitation on Thursday and started to report sick. The management has terminated the services of seven pilots and suspended six others."We are extending our 100 per cent support to our agitating younger brothers in the ICPA, over 300 executive pilots have reported sick and now it is up management to take action against all 800 pilots," said a senior pilot. Out of 69 executive pilots, 68 had on Thursday reported sick in Delhi and at other bases.   On Thursday, the management initiated contempt of court proceedings against the pilots in the Delhi High Court but the pilots remained unfazed. Also, the conciliation talks between the management and the agitating pilots also ended in failure as both were not ready to budge from their position.Around 800 pilots, of erstwhile Indian Airlines, associated with Indian Commercial Pilots Association (ICPA) are on strike since Tuesday midnight demanding fixed salary, removal of AI CMD and CBI probe into alleged mismanagement.

Sathya Sai Puttaparthi Faces Uncertainty

A sense of uncertainty looms large among people over the future of this town following the demise of Sathya Sai Baba, who transformed this once remote and faceless village into a thriving pilgrim centre. As thousands of devotees left this town after having their last 'darshan' of Sai Baba, the locals are not sure if they will ever come again. "We don't know what will happen now.     The business may not be the same as it used to be earlier," said M Raj Kumar, who runs a grocery shop. Small traders, who sold pictures of Sai Baba, flowers and other items, are also a worried lot. With about 25,000 residents, Puttaparthi was once unknown to the outside world and lacked even basic amenities. Sai Baba, who was born here in 1926 and claimed at age 14 that he was an avatar of god, put it on the pilgrim map by building his ashram Prshanti Nilayam. Many eminent pilgrims, including retired bureaucrats, police officers, judges and their family members, settled down in the town to remain close to the man they considered god.   The Sri Sathya Sai Central Trust, formed by Sai Baba in 1972, ran schools, a university, a super speciality hospital and other institutions, providing free education and medical treatment. It also developed an airport to facilitate the flow of devotees including heads of states and governments as well as celebrities. Over the last two decades, the land cost in the town went up many times. Land in Puttaparthi is more costly than in Anantapur town. Sathya Sai Baba had claimed to a reincarnation of the celebrated saint of 19th century. "We don't expect the kind of crowds when Swami was there but devotees will continue to come," said R Subba Rao, owner of a lodge.

AI Pilots Strike: 60 Flights Cancelled

Flyers today bore the brunt of the strike by Air India pilots with some complaining that they were not informed about the status of their flights and some coming to know about the cancelled flights only after reaching the airport.Air India cancelled 60 flights this morning leaving many flyers stranded."Me and my family had to attend a marriage in Srinagar today and we had booked our tickets about a month ago, but now our plans are ruined as Air India has cancelled the flight and they don't have the courtesy to inform us before hand," said Mohammed Sahil Sheikh,   The Air India pilots strike and with 60 flights cancelled since Wednesday and Thursday morning, it is the passengers who are bearing the brunt.Showing solidarity with the striking pilots 32 executive Air India pilots reported sick to work in Mumbai on Thursday. The Delhi High Court though has stayed the flash strike and has ordered the pilots to resume work. There has also been a warning from the Civil Aviation Minister Vyalar Ravi and he has assured normal services will resume soon.Six pilots have already been sacked and two have been suspended.   The Indian Commercial Pilots Association (ICPA) too has been derecognised but still there has be no change of stance from the pilots. Passengers faced the worst brunt of the tussle between the 650 pilots of the Indian Commercial Pilots Association and the airline management. Several flights were cancelled or delayed leaving hundreds of passengers stranded and misinformed.The pilots are demanding the ouster of Air India Chairman Arvind Jadhav and a fixed pay salary. As of now, they get paid according to the number of hours they fly. But with route cancellations after the Air India-Indian Airlines merger, they claim they get just 60 per cent of their salaries.   The Delhi High Court on Wednesday stayed the flash strike by 600 pilots of Air India, who were co-opted from erstwhile Indian Airlines, but not before slamming the management for not addressing their demands for some two decades.The court's decision came even as nearly 50 flights, mainly out of the national capital and Mumbai, had to be cancelled and an equal number rescheduled due to the strike since Tuesday midnight, causing inconvenience to thousands of air travellers in the country.

State Challenges CAT On DGP Post

The state government has decided to challenge the ruling of the CAT nullifying the appointment of the DGP, Mr K. Aravinda Rao, before the AP High Court. The Bench ruled that Mr Aravinda Rao’s promotion to DG, not DGP (HOPF), was valid from September 1, 2010. Mr Rao was appointed as the HOPF on August 31, 2010, after Mr Girish Kumar retired. A two-member bench comprising Ms Bharati Ray and Mr R. Santhanam, while allowing a petition filed by principal secretary to the home department, Mr P. Gautam Kumar, challenging the appointment of Mr Rao, directed the state government to take up the process of appointment of the new DGP afresh and complete it before June 1. Mr Kumar had contended that Mr Rao was ineligible for the post of DGP and several eligible DG-ranked officers had been ignored.   The bench declared that the action of the state government in adding six DG-rank posts to its cadre on May 17, 2010, without there being sufficient vacancies was in violation of IPS cadre rules and quashed the promotions of the six officials including Mr Aravinda Rao's. The state government had promoted Mr Aravinda Rao, Mr A. Siva Shankar, Mr Umesh Kumar, Mr V. Dinesh Reddy and Mr Alok Srivastava. The CAT, however, held that the promotion of Mr Siva Shankar was valid from May 18 and of Mr Umesh Kumar from June 16, 2010, since two vacancies were available as on these dates in the rank of DGP (HAG scale). The CAT said that the promotions of Mr Aravinda Rao and Mr Alok Srivastava to DGP (HAG scale) were valid from September 1, 2010 and the promotion of Mr Dinesh Reddy was valid from November 1, 2010. Referring to the case of Mr M. Bhaskar, another senior IPS officer who was promoted to the DG rank later, the tribunal held that his promotion was invalid till date because there was no vacancy in the DG rank posts and he would have to wait for his turn.The CAT ruled that the promotion of another IPS officer, Mr M. Alagar, to DGP (HAG plus) was invalid and could not be cured even from a subsequent date because he had already retired from service.   The Bench observed that his pension and other retirement benefits would have to be reworked accordingly. Referring to the selection process, the CAT directed the state government to forward the dossiers of DG rank officers, Mr K.R. Nandan, Mr P. Gautam Kumar, Mr A. Siva Sankar, Mr Umesh Kumar, Mr K. Aravinda Rao and Mr Alok Srivastava, along with those who are on the central deputation to the Union Public Service Commission within two weeks from Wednesday. The Bench also asked the UPSC to short-list them and prepare a three-member panel from this and sent it back to the state which should select one from it before June 9, 2011.   The Bench observed that if Mr Aravinda Rao was selected in the process, then the service he had rendered so far as the DGP HOPF would be found valid from the date of his appointment as the DGP HOPF. Otherwise, it would be considered as a notional holding of the post without any monetary benefits. The previous case pertains to the former director-general of the Border Security Force, Mr Prakash Singh, who had filed a public interest litigation seeking reforms in the Indian Police system. The efforts of Mr Singh led to a landmark judgement of the SC that set guidelines for the selection of head of the police force of states in India.

No Govt Involment in Sai Baba Trust

The Government says it will not interfere in the affairs of the lucrative Sri Satya Sai Central Trust at least for the time being. The Rs 40,000 crore trust set up by the late Satya Sai Baba administers several charities in and outside the country. For the first time since Baba fell ill and passed away, senior trustee Justice P.N. Bhagwati spoke to the media on Wednesday.   He said there is no successor to Sri Satya Sai Baba. Baba, who headed the trust as founder trustee was a bachelor and did not name any shishya to take on the mantle after him. Instead, he constituted different trusts with eminent people as trustees to ensure the smooth running of the hospitals, educational institutions and other service institutions funded by the trusts. Barring his nephew Mr R.J. Rathnakar, Baba’s family members were kept away from the trust's activities.   There are no differences between the Trust members and family members of Baba. We will continue with the programmes initiated by Baba,” Justice Bhagwati said, obviously referring to rumours that family members of the Baba want more say in the various trusts.Sources say that the trust is planning to promote Puttaparthi on the lines of Shirdi in Maharashtra, made famous as a spiritual centre by the Sai Baba of Shirdi. The AP Governor, Mr E.S.L. Narasimhan, and Chief Minister, Mr N. Kiran Kumar Reddy, have had informal discussions on trust matters with the trustees. The trustees have promised to continue the legacy and programmes of Sri Satya Sai Baba and sought the cooperation of the State government. The Government assured the trustees that it would not interfere as long as there are no complaints of mismanagement, according to trustees.   The state BJP president and MLA, Mr G. Kishan Reddy, who attended the funeral on Wednesday, said there was no need for the Government to interfere in the trust’s affairs, since the trust is serving the people well.Government should not try to take over the trust. The trust has eminent people and it is the duty of everyone to ensure it runs smoothly,” he said.

Controversy Over Sathya Sai Baba Death

The controversy  began  on Wednesday after a firm making freezer boxes claimed the one in which the 'godman' was kept as its own and said it was ordered on April 4. While it is not uncommon to order a freezer box in advance, the response of the Central Trust members as well as the district administration that they have no information on it has, in fact, led to many doubting the reported date of his death.   The order was placed by Rajendranath Reddy of Bangalore to the Malleswaram (Bangalore) branch of Coimbatore-based Kumar and Co. International. The cost of the glass freezer was quoted at Rs 1.07 lakh and an advance of Rs 57,000 was paid by cheque to the company on April 4. "The box was transported from Coimbatore to Ulsoor in Bangalore on April 4 and reached Puttaparthi on April 5," said Vishwanath, a staff in Kumar and Co. The connection of Rajendranath Reddy with Sathya Sai Central Trust still a mystery. However, according to sources, the powerful Sri Sathya Sai Central Trust had a role in ordering the freezer box. Lakshmi, the owner of Kumar and Co International company, told the media on Wednesday that she recognised the freezer box as made by her firm after seeing it on TV. "We did not know it was meant for Sai Baba," she said.   According to Lakshmi, her colleague Ganesh called Rajendranath to confirm this. "He confirmed the same and told Ganesh not to discuss the matter with anyone," Lakshmi said. While Trust member S S Naganand said that the freezer box was arranged by the godman's family, another member ex-justice P N Bhagwati said: "I am not aware when the freezer box was ordered or brought to Puttaparthi. I also have no information as to who ordered it and when. Anantapur district collector B Janardhan Reddy also said that they had no information on the freezer box.

Kiran Kumar Strategy For Kadapa Bypolls

Chief Minister N Kiaran Kumar Reddy's poll-strategy for the ensuing Kadapa bypolls reminds one of 'Padmavyuham' strategy, adopted in the epic Mahabharatham that cornered Abhimanyu. Of course, the same strategy was also adopted in 1996 by then chief minister Chandrababu Naidu against late YS Rajasekhar Reddy. Though Naidu could not stop YSR winning the Kadapa seat, but succeeded in drastically reducing YSR's winning margin to just 5000 votes. The Congress party feels that a similar game plan would help to bring down the majority of YS Jaganmohan Reddy, even if Congress fails to win over the seat. The unique feature of the strategy is to ensure presence of a large number of police and prevent rigging to the extent possible and motivate people to come out and vote. Following the same strategy, already 50 companies of central paramilitary forces have been deployed in Kadapa and another 80 companies are expected to arrive after the ongoing polls in the five states. In addition, 5,000 armed reserve and special police have also been deployed in seven assembly segments of Kadapa Lok Sabha constituency. Apart from this, more than 2000 women constables and nearly 1500 home guards will also be deployed in Kadapa Lok Sabha segment. The strategy is clear, on one side, more number of police will be deployed so that Jagan and his followers cannot indulge in rigging and on the other,  the polls will be held under direct control of the administration. Another aspect of the strategy is to devide the electorate on the lines of caste and religion. While Kanna Laxminarayana is trying to woo Kapu votes in Balija-dominated areas, former CM Rosaiah and minister TG Venkatesh have been asked to campaign in Vysya-majority areas. Minister Ahmadulla, former minister Shabbir Ali, deputy chairman of legislative council Mohd Jani are camping in Muslim dominated areas. Ministers D Manikya Varaprasad and Sailajanath are given the responsibility of villages where the SC population is more.  

Doubts on How Arunima Sinha Lost Her Leg

The Government Railway Police is having its own doubts on how Arunima Sinha lost her leg. The GRP team that is probing the athlete's case has found loopholes in the version given by Arunima Sinha that she lost her leg after being thrown out of a train by robbers in Bareilly. ADG, Railways AK Jain said, "The investigations point out that Arunima was disturbed and she either attempted suicide or met with an accident. We will unravel it in the next few days. The 'robbery' attempt as alleged by her was not corroborated in the investigation by any of the witnesses on or off the record." During investigation, it was found that no physical test for ITBP was scheduled for April 11 in Noida, where Arunima said she was heading. Also, she was found at a spot, which was 16 feet away from the up track on which Padmavat express passed and she was lying on the far side of the adjacent down track, the investigators said, adding that it was impossible to land so far, if pushed out of the train. Arunima's version that the speed of the train was very fast was also found to be "untrue" as after halting for 12 minutes at Chanaiti Railway Station in Bareilly, Padmavat Express moved 250 meters (the spot, where she was found), where the speed cannot be more than eight km/hour, according to the investigators. According to her mobile records, before coming to the station she made a call to her friend Sanjay in New Delhi from Kursi road. Sanjay had told police that Arunima was disturbed and suddenly made a plan to visit Delhi. Reacting to what the police says, Arunima said over phone from New Delhi that she was being 'mentally harassed'.  "I don't know whether the police is with me or against me. I was going to CISF, Noida office to inquire about the Centre for physical exam scheduled on May 7 and to ensure a correction in my date of birth in the call letter I have received," Arunima said.
